Once a sales order has been received, a non-refundable deposit of 25% of the value must be paid upfront.
It is the responsibility of the Client to ensure that usage of any Products do not infringe the rights (whether in law or other rights) of any person who appears in or property owner whose property is depicted in any of the Products.
The Client agrees that it will indemnify and hold EPQ Media harmless for any liabilities or damages arising out of the Clients's use of any Products supplied under these Terms and also for any breach of these Terms by the Client.
Project prices are based on either a half-day or a full-day rate for the on-site shoot and then afterwards, on an hourly rate for editing.
EPQ Media retains the right to incorporate watermarks on all Products until invoices have been paid in full.
The payment due date shall be determined solely by the payment terms stated on the invoice. - Where no term is specified, payment will be due before the Products are released and the funds have cleared into EPQ Media's bank account.
A payment is deemed received when a timed receipt is issued or where funds are sent (either by Debit or Credit card) and those funds have been cleared in EPQ Media's bank account. For the avoidance of doubt, it is the responsibility of the Client to ensure that funds are received by EPQ Media on or before close of business on the payment due date.
Any use of Products before payment is received is unauthorized.
Additional Work requested during the contract will be chargeable.
Copyright of the Product is retained by EPQ Media and may not be reproduced or used for marketing purposes until all invoices have been paid in full.
EPQ Media may from time to time at their sole discretion use the Product for inclusion in a display, showreel or portfolio or for other purposes including but not limited to entering into photographic competitions or other exhibitions. Where any such use results in a benefit (for example a competition prize or exhibition fee) that benefit shall be retained exclusively by EPQ Media.
